THE TERMS AND CONDITIONS FORM A CONTRACT BETWEEN THE CUSTOMER AND DMP TRAINING (UK) LTD.
DEFINITIONS
- The "Buyer" means the person who buys or agrees to buy courses or services from the Seller.
- The "Seller" means DMP Training UK Ltd.
- "Conditions" means the Conditions of Sale set out in this document and/or any special conditions agreed in writing by the Seller.
These "Terms and Conditions" do not affect your statutory rights as a consumer.
All contracts of sale made by DMP Training UK Ltd shall be deemed to incorporate these Terms and Conditions which shall prevail over any other communication or document from the Buyer of the course or service.
PRICES
a) The Price will be what is stated on the Seller's current list price, web site, or if applicable the price stated in the Seller's quotation. b) The total purchase price including VAT will be displayed in the Buyer's shopping cart prior to confirming the order.
PAYMENT TERMS:
a) Payments are requested at the time of booking a course or service. b) Payments made by cheque should be made payable to 'DMP Training UK Ltd. c) All payments for courses must be received in full at least 15 days prior to the course start date unless other arrangements have been agreed with DMP Training (UK) Ltd. d) If full payment is not received 15 days prior to the booking requested by a customer, the course place may be lost. e) In the case of price of courses or services requested by invoice the payment is due in full on the terms of credit agreed which shall not be more than 30 days from the date of invoice.
CANCELLATION AND REFUND POLICY
a) All cancellations must be made in writing to DMP Training (UK) Ltd. If you cancel your course: b) More than 15 days before the start date of the course date we will charge an administration fee 25% of the total course fee plus VAT. c) Less than 15 days before the course start date will result in the entire course cost being forfeited. d) Substitution of course candidates, subject to examination board criteria (where applicable), will be accepted upon reasonable notice being given. In this case and the original booking and fee will to be accepted without incurring further cost e) DMP will aim to ensure that courses run as planned. However, there may be times when, due to circumstances beyond our control, we have to cancel or make variations to the date of a course. If this occurs customers will be given as much notice as possible and any course fees already paid for the cancelled course will be refunded in full. Priority will be given to those wishing to attend the next available course. Unfortunately, we are unable to reimburse any expenses that may have been incurred.
DRIVERS HOURS AND WORKING TIME REGULATIONS:
a) The training of mobile workers is deemed to be 'other work' for the purposes of drivers' hours and Working Time Directive regulations. Employers and drivers must ensure that drivers are not infringing their rest requirements by attending training.
GENERAL
a) Any course candidates who are deemed to be under the influence of drink or drugs, acting in a disruptive or not adhering to training centre rules will be asked to leave the course and any fees paid will not be refunded. b) Every effort will be made to ensure that any course notes, presentations or tuition materials are accurate. DMP Training (UK) Ltd does not accept responsibility for any errors or omissions. c) DMP Training (UK) Ltd does not accept responsibility for personal belongings or vehicles left on the premises. d) Where external examinations are involved and enrolment details have been supplied by the delegate, DMP Training (UK) Ltd cannot accept responsibility for the accuracy of such details if a dispute should arise with the examination body. e) It is the course candidate's responsibility to ensure that adequate provision is made to ensure that drivers attending courses are able to comply with the rest requirements laid down in Drivers' Hours Regulations and the Working Time Directive. f) All candidates must comply with DMP Training (UK) Ltd Safety Policy and their legal obligations under the Health & Safety at Work Act 1974 and other relevant provisions. g) If a candidate wishes to make a complaint this must be made in writing and sent recorded delivery within seven days of the course ending. All complaints will be dealt with fairly by DMP Training (UK) Ltd.

CONFIDENTIALITY AND DATA PROTECTION
DMP Training (UK) Ltd will keep confidential any information supplied in the process of booking and providing courses or services, with the exception of details required for partner organisations for tests or accreditation. Basic personal details will not be shared with other Training partners or potential employers without prior consent. DMP Training will be responsible foe ensuring that the processing of personal data complies with the Data Protection Act, 1998.
